This document is exclusively concerned with questions of liability, and the limitation and exclusion thereof. For instances, a newsletter may create issues under the law of copyright or defamation. The disclaimer does not, for example, cover any usage or licensing issues that may be associated with a newsletter.

This is a standard disclaimer designed for use in relation to a newsletter, whether the newsletter is printed, electronic or both.

The sorts of risk that a newsletter may bring – the subject matter of the disclaimer – will vary from newsletter to newsletter.  For example, a newsletter about nutrition could, if things went badly wrong, lead to personal injury claims.  The disclaimer is intended to help with this kind of issue, although you need to be aware that in any particular set of circumstances there is a risk that a disclaimer will be found to be unenforceable.

Examples of the sections in this newsletter disclaimer include the following:

  • “The newsletter contains information about [subject matter].  The information is not advice, and should not be treated as such.”
  • “Without prejudice to the generality of the foregoing paragraph, we do not represent, warrant, undertake or guarantee … that the information in the newsletter is correct, accurate, complete or non-misleading.”
  • “We will not be liable to you in respect of any special, indirect or consequential loss or damage.”
  • “If a section of this disclaimer is determined by any court or other competent authority to be unlawful and/or unenforceable, the other sections of this disclaimer continue in effect.”
